New York AG Sues Insys Therapeutics Over Opioid Marketing

The New York Attorney General's Office ("NYAG") announced that it has sued Insys Therapeutics, alleging that the company deceptively marketed the drug Subsys for unsafe uses.  

Although the drug was approved by the Food and Drug Administration for the treatment of serious cancer pain, the NYAG alleged that the company recklessly marketed the drug for wider use.  

The NYAG is seeking penalties and disgorgement of all revenues from sales of the drug during the period of alleged misconduct.  

“At a time when the opioid epidemic was ravaging New York, Insys Therapeutics allegedly marketed a drug illegally by blatantly disregarding the grave risks of addiction and death that opioids pose,” said Attorney General Schneiderman.
